End User License Agreement
Arbiter Intelligence Gaming Edition | Version 1.0 | Effective January 2026
1. Definitions
- "Software" refers to the Arbiter Intelligence application, including all associated files, documentation, updates, and support materials.
- "You" or "User" refers to the individual or entity who has purchased or is using the Software.
- "License" refers to the rights granted to you under this EULA.
- "Arbiter Intelligence LLC" or "We" refers to the licensor of the Software.
2. License Grant
Subject to your compliance with this EULA, Arbiter Intelligence LLC grants you a limited, non-exclusive, non-transferable, revocable license to:
- Install and use the Software on devices you own or control
- Use the Software for personal or commercial gaming performance analysis
- Create performance reports and export data for your own use
2.1 Individual License
An Individual License permits use by a single user on up to three (3) devices owned or controlled by that user.
2.2 Commercial License
Commercial use (including content creation, tech support services, or business applications) is permitted under all license types. You may share reports and analysis generated by the Software with clients or audiences.
3. Restrictions
You may NOT:
- Modify, reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software
- Remove, alter, or obscure any copyright, trademark, or proprietary notices
- Distribute, sublicense, rent, lease, lend, or transfer the Software to third parties
- Use the Software to develop competing performance analysis tools
- Bypass, disable, or circumvent any licensing or security mechanisms
- Use the Software for any illegal purposes or to violate any laws
4. Intellectual Property Rights
The Software is licensed, not sold. Arbiter Intelligence LLC retains all rights, title, and interest in and to the Software, including all intellectual property rights. This includes but is not limited to:
- Source code, algorithms, and proprietary analysis techniques
- User interface design and report templates
- AI models, machine learning algorithms, and baseline databases
- Trademarks, logos, and branding materials
5. Data Collection and Privacy
All performance analysis is performed locally on your device. Arbiter Intelligence does not collect, transmit, or store any of your data on remote servers. Your gaming performance data, hardware information, and reports remain entirely on your computer.
We do not collect:
- Performance metrics or gaming data
- Hardware configurations or system information
- Usage statistics or feature analytics
- Crash reports or error logs
- Personal information or identifiable data
Your privacy is paramount. What happens on your PC stays on your PC.
6. Updates and Support
6.1 Software Updates
We may provide updates, patches, and new versions of the Software. Updates may be automatically downloaded and installed. You may disable automatic updates in Settings, but this may affect functionality or security.
6.2 Technical Support
Licensed users receive technical support via email at support@arbiterintelligence.com. We strive to respond within 48 hours during business days. Support includes:
- Installation and configuration assistance
- Troubleshooting performance issues
- Report interpretation guidance
- Bug reporting and resolution
7. Warranty Disclaimer
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. Arbiter Intelligence LLC disclaims all warranties, including but not limited to:
- Warranties of merchantability and fitness for a particular purpose
- Warranties that the Software will be error-free or uninterrupted
- Warranties regarding performance improvements or FPS gains
We do not guarantee that applying optimizations will result in specific performance improvements. Results vary based on hardware, software configuration, and game-specific factors.
8. Limitation of Liability
IN NO EVENT SHALL ARBITER INTELLIGENCE LLC BE LIABLE FOR:
- Any indirect, incidental, special, exemplary, or consequential damages
- Loss of profits, revenue, data, or use arising from use of the Software
- Damages from hardware failures, system crashes, or data loss
- Damages exceeding the amount paid for the Software license
Some jurisdictions do not allow limitation of liability for incidental or consequential damages, so this limitation may not apply to you.
9. Refund Policy
All purchases are made through Steam and are subject to Steam's refund policy. Please refer to Steam's terms for refund eligibility.
10. Termination
This license is effective until terminated. Your rights under this license will terminate automatically without notice if you fail to comply with any term of this EULA.
Upon termination, you must:
- Cease all use of the Software immediately
- Uninstall the Software from all devices
- Destroy all copies of the Software in your possession
11. Third-Party Software
The Software incorporates open-source components licensed under their respective licenses:
- PresentMon (Intel Corporation) - MIT License - Frame timing and GPU metrics capture
- Microsoft.Diagnostics.Tracing.TraceEvent - MIT License - ETW trace analysis
- Python.NET (pythonnet) - MIT License - .NET interoperability
- psutil - BSD-3-Clause License - Process and system utilities
- Plotly.js - MIT License - Interactive chart rendering in HTML reports

12. Governing Law
This EULA shall be governed by and construed in accordance with the laws of the United States of America, without regard to conflict of law principles. Any disputes arising from this EULA shall be resolved in the courts of competent jurisdiction.
13. Entire Agreement
This EULA constitutes the entire agreement between you and Arbiter Intelligence LLC regarding the Software and supersedes all prior or contemporaneous agreements, communications, or understandings.
14. Amendments
We reserve the right to modify this EULA at any time. Changes will be effective upon posting to our website or distribution with Software updates. Continued use of the Software after changes constitutes acceptance of the modified EULA.
